Terms of Service

The agreement between Adaptiwise AI and the business that holds an account: what the service does, what it does not promise, and who is responsible for what.

1Who these terms are between

Adaptiwise AI is booking, customer-record, messaging and payment software for small businesses and clinics. It runs at app.adaptiwise.com and is described at adaptiwise.com. In these terms Adaptiwise AI, we and us mean the operator of this deployment — registered legal name, business number and address: for the operator to complete — and you means the business that holds an account.

These terms bind the business. If you reached this page from a booking confirmation, your agreement about that appointment is with the business you booked with, not with us: they set the price, the service and the cancellation policy, and they are the organisation accountable for your record. What we do with that record is in the Privacy Policy.

Using Adaptiwise AI means accepting these terms. If you do not accept them, do not use the service.

2Accounts, workspaces and who may see what

We may suspend an account being used to break these terms — in particular one used to message people who did not ask to hear from it, or to try to reach another workspace's data.

3What the service does, and what it does not promise

Everything that leaves the system — a text message, an email, a card charge — goes through an outside provider. A deployment can run those providers in a sandbox, which is the default: the product behaves the same way, but no message is delivered and no card is charged. Screens that report money or delivery say which mode they are describing.

5Bookings and your cancellation policy

Your booking page applies the rules you set: how much notice you need, how far ahead people may book, your cancellation window, and any late-cancellation fee. A customer has to accept your cancellation policy before a booking is taken, and the fee it authorises is the one you configured.

Adaptiwise AI is not a party to the appointment. We show and apply the rules you configured. The service, the price, any fee charged under your policy and any dispute about them are between you and your customer.

10Warranties and liability

Adaptiwise AI is provided as is. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and we are not liable for lost profits, lost bookings, lost data or indirect loss.

Nothing here limits what may not be limited. Canadian consumer-protection legislation, and liability for fraud, for fraudulent misrepresentation or for personal injury caused by negligence, are unaffected by anything in this section.

The total liability of the operator under these terms is capped at the cap the operator agrees with counsel — to be completed.

11Changes to these terms

We may change these terms. The date at the top of this page changes with them, and a change that materially affects an account holder will be notified to the account holder rather than left to be discovered here. Continuing to use the service after a change means accepting it.

12Governing law

These terms are governed by the law of the province and country the operator settles on with counsel — to be completed, and the courts there have jurisdiction. This is one of the terms the draft notice at the top of this page is about: it has been left unfinished rather than guessed.
